Netflix (NASDAQ:NFLX) was hit hard pre-market by Wedbush?s lack of confidence. Wedbush believes that Q1 earnings will be poor, and 2012 consensus estimates ill drop a buck a share. Piper Jaffray, for what it?s worth, is optimistic about Netflix, as they think the customer base will stabilize and ultimately grow again.

Halliburton?s?(NYSE:HAL) results came in this morning, and although EPS and revenues beat estimates, the higher expectations of the market were not met. Interesting tidbit: unconventional oil drilling has twice as much activity as unconventional gas drilling.

Amgen (NASDAQ:AMGN): The entire pharmaceutical sector is being downgraded, and Amgen is no exception. Its stock has been downgraded to underweight by JP Morgan.

Earnings Report: PetMed Express Inc. Earnings: Shrinking Margins for Fifth Consecutive Quarter, Net Income Falls.

Sears Holdings Corporation (NASDAQ:SHLD): The performance of this stock has been remarkable: up 69% year to date, the stock jumped by 8% before coming down close to where it started at the beginning of trading. Some believe Sears is now in a classic short squeeze.

Southwestern Energy Co. (NYSE:SWN) popped along with other natural gas producers because the spike of prices and Chesapeake?s planned cuts in production.

Chesapeake Energy Corporation (NYSE:CHK): After sinking overnight to $2.20, natural gas futures jumped 6.4% in a matter of minutes. Apparently there were too many short-sellers in the natural gas market, and the market has taken care of them for the time being.

American Idol to President Obama & Al Green: Sing For Us!

If you haven't seen the video of President Obama singing Al Green at a fundraiser at New York City's legendary Apollo Theater last week, you need to.

No matter what you think of his views, the Prez proved with his riff on "Let's Stay Together" that he's got pipes! And we weren't the only ones impressed.

American Idol executive producer Nigel Lythgoe Tweeted an offer to the Commander in Chief that he can't refuse. Or at least he shouldn't:

"@BarackObama we loved your vocal performance so much we'd love to invite you on to #AmericanIdol this Season for a duet with Al Green."

Now that would be the DVR moment of the decade.

We're gonna guess that Obama will cite scheduling conflicts and pass, but if you think about it, what better way to win over voters in an election year?

Okay, perhaps a robust economy would be a bigger ballot box boost, but you get the idea. The guy's vocal chops need to be showcased more often.

Body location plays part in scratching pleasure

ScienceDaily (Jan. 27, 2012) ? An itch is just an itch. Or is it? New research from Gil Yosipovitch, M.D., Ph.D., professor of dermatology at Wake Forest Baptist Medical Center and a world-renowned itch expert, shows that how good scratching an itch feels is related to the itch's location.

While previous studies by Yosipovitch have shown the pleasurability of itching, analysis of itch relief at different body sites and related pleasurability had not been performed until now. The study was published online this month by the British Journal of Dermatology.

"The goal of this study was to examine the role of the pleasurability of scratching in providing relief for itch," Yosipovitch explained. "We first evaluated whether itch intensity was perceived differently at three body sites, and then we investigated the potential correlation between the pleasurability and the itch relief induced by scratching."

Yosipovitch and colleagues induced itch on the ankles, forearms and backs of 18 study participants with cowhage spicules, which come from a type of legume found in tropical areas that are known to cause intense itching. The spicules were rubbed gently in a circular motion for 45 seconds within a small area of the skin and removed with adhesive tape once itch was induced. Itch intensity and scratching pleasurability were assessed every 30 seconds for a duration of five minutes using a Visual Analog Scale (VAS) to rate intensity -- 0 for no itch, up to 10 for maximum unbearable itch.

Their results show that itch was perceived most intensely at the ankle and back, while the perception of itch and scratching relief were less pronounced on the forearm. Another major finding of the paper, as Yosipovitch explains, is that "the pleasurability of scratching the ankle appears to be longer lived compared to the other two sites." Yosipovitch said this research helps lead to a better understanding of itch and how to relieve it for people who have skin disease.

"We see commonly involved areas such as the ankle and back in itchy patients with skin disorders caused by eczema or psoriasis," he said. "We never understood why those areas were more affected, and now we better understand that itch in these areas is more intense and pleasurable to scratch."

Yosipovitch said that while it is known that small nerve fibers are involved in unpleasant sensations such as itch and pain, he and other researchers now suspect that there are also specific nerve fibers involved in pleasure.

"If we could translate this to a treatment that induces a pleasurable relief sensation without damaging the skin, we may be able to help itchy patients," he said.

This study was supported by the National Institute of Arthritis and Musculoskeletal and Skin Disease.

RIM?s New CEO Backtracks: ?There Is A Lot Of Change?

ThorstenHeinsOn Monday of this week, RIM's new CEO made a statement that set off a bomb on the blogosphere, and I'm not sure he understood its repercussions at the time. "I don't think any drastic change is needed." If you've been paying attention to RIM and its numbers, you know that what the company desperately needs is change. Sales are declining, platform market share is dwindling, and the BlackBerry brand, to a large extent, has lost the power it once had behind it. So in a recent interview with CrackBerry, Heins made sure to clarify exactly what he meant by "no drastic change is needed."

HONOLULU (AP) ? Many NFL stars are hoping that when it comes to the Pro Bowl in Hawaii, aloha doesn't mean goodbye.

The NFL all-star game doesn't have a home beyond Sunday's game. League and Hawaii officials are negotiating a deal to keep the game in the islands, which is hosting it for the second straight year after it was played in Miami in 2010, breaking a 30-year run in Hawaii.

"It takes away from the game when it's somewhere else," said Miami Dolphins receiver Brandon Marshall, who also selected to the Miami game two years ago. "It's always a privilege. It's always an honor to be selected to a Pro Bowl. But this is what the Pro Bowl is about ? paradise. So it would (stink) definitely if we no longer come out here."

Some players went as far as saying they wouldn't participate if the Pro Bowl was moved.

"That's a lot of the players' attitude, I think. If it's in an NFL city, you're in those cities quite often," Minnesota Vikings defensive end Jared Allen said.

Allen and other players said the game belongs in Hawaii, where it's more family oriented, relaxed and considered a reward for the hard work they put it during the season.

Jacksonville running back Maurice Jones-Drew's first Pro Bowl was in Miami, which he said was a great experience.

"But it's nothing like coming over to Hawaii. This is my first time here for the Pro Bowl, and it's great," he said.

In Hawaii, the players are treated to a beachside hotel to themselves. They sip on colorful, tropical drinks and lounge around the pool, golf or wade in one of the white-sand lagoons at Ko Olina Resort.

"In Miami, we didn't have the whole hotel. You're signing autographs 99 percent of the time at the hotel. It was just chaotic," Allen said. "Guys weren't showing up. You had a lot of alternates in and out. Over here, it's kind of what everybody looks forward to. ... I like it here. I'm a big fan of tradition. It started here. We should keep it here."

But the Pro Bowl wasn't born here. It was hosted for years in Los Angeles before jumping around the country in the 1970s, going everywhere from the Kingdome in Seattle to the Arrowhead Stadium in Kansas City.

The game was first played at Aloha Stadium in 1980 with New Orleans Saints running back Chuck Muncie leading the NFC to a 37-27 victory. The winners earned $5,000. On Sunday, the winners earn nearly 10 times that amount.

The state is paying the NFL $4 million per game for the rights to hold this year's game. About seven months ago, Gov. Neil Abercrombie opposed the cash-strapped state paying millions to host the Pro Bowl when the money could be used for education.

"You can't do things like give 4 million bucks to a $9 billion football industry and not give any money to children," Abercrombie said then. "You've got this spectacle of these multimillionaires and billionaires out there arguing about how they're going to divide it up, and then they come and ask us to bribe them with $4 million to have a scrimmage out here in paradise.

"We've got to get our values straight and our priorities straight."

On Tuesday, however, Abercrombie changed his tune when he crashed the NFL's press conference and spoke in favor of keeping the game here. The governor said the state would like to continue hosting the game, "and we're going to do everything we can to make sure that comes about in a fashion that will make everybody very, very happy."

A House economic development committee on Thursday will discuss establishing a Hawaii Sports Task Force to coordinate efforts to keep the Pro Bowl in Hawaii, as well attract other pro sporting events.

Last year's Pro Bowl attracted 17,000 visitors to the state, generated $28.2 million in visitor spending and created $3.1 million in state taxes from people who traveled to attend the game.

Hawaii Tourism Authority President and CEO Mike McCartney said the agency is still in discussion with the NFL for the future of the Pro Bowl beyond 2012.

"We have enjoyed a wonderful partnership with the NFL and we look forward to continuing this relationship as well welcoming the NFL players, their families and all the fans for an exciting game on Sunday," he said in a statement.

Denver Broncos cornerback Champ Bailey is no stranger to the islands. Bailey is making his 11th trip to the Pro Bowl.

"A lot of people wouldn't come to Hawaii if not for the Pro Bowl," Bailey said. "It would be disappointing if they moved it, but I have no say in it. If I did, I would say keep it here because I love it here."

Perhaps no one is enjoying it more this week than Oakland kicker Sebastian Janikowski, who is making his first trip to the Pro Bowl in a dozen seasons in the league.

"Twelve years," he said. "I've been waiting a long time for this. Hopefully many more to come. Every time somebody asks me how many times I've been here and I say it's my first, they seem to be surprised and shocked. I'm just happy I got here, finally."

U.S. Marine spared jail time in Iraq killings (Reuters)

CAMP PENDLETON, Calif (Reuters) ? A U.S. Marine sergeant accused of leading a 2005 massacre of 24 civilians in Haditha, Iraq, was spared jail time on Tuesday for his role the killings that brought international condemnation of American troops.

Staff Sergeant Frank Wuterich, 31, was sentenced instead to a demotion to the rank of private, the lowest rank in the service, a day after he pleaded guilty to a single count of dereliction of duty.

Wuterich, who could have faced a maximum penalty of three months in confinement, showed no emotion as a military judge pronounced his sentence.

More serious charges of involuntary manslaughter and aggravated assault had already been dismissed as part of a plea deal, which cut short Wuterich's court-martial and was decried by a victim's relative as "an insult to all Iraqis."

As part of his guilty plea, Wuterich accepted responsibility for providing negligent verbal instructions to the Marines under his command when he told them to "shoot first and ask questions later," which resulted in the deaths of innocent civilians.

In a pre-sentencing statement, Wuterich said that when he gave that order, "the intent wasn't that they should shoot civilians. It was that they would not hesitate in the face of the enemy."

Wuterich was accused of being the ringleader in a series of November 19, 2005, shootings and grenade attacks that left two dozen civilians dead in Haditha, a city west of Baghdad that was then an insurgent hotspot.

The killings were portrayed by Iraqi witnesses and military prosecutors as a massacre of unarmed civilians -- men, women and children -- carried out by Marines in anger after a member of their unit was killed by a roadside bomb.

Defense lawyers argued the deaths resulted from a fast-moving combat situation in which the Marines believed they were under enemy fire.

The squad leader, who was originally charged with murder in the case, said he realized that his name "will always be associated with a massacre, being a cold-blooded baby killer, an 'out-of-control monster.'"

But he insisted that he and his fellow Marines behaved honorably under extreme circumstances, and said he "never fired my weapon at any women or children that day."

OUTRAGE IN IRAQ

Word of the maximum sentence sparked outrage in Iraq, where Ali Badr, a Haditha resident and relative of one of the victims, called it "an insult to all Iraqis" and "solid proof that the Americans don't respect human rights."

In his statement on Tuesday, Wuterich, directed an apology to family members of those killed in Iraq, he said, "Words cannot express my sorrow for the loss of your loved ones." But he said civilians were not singled out for attack.

"The truth is, I don't believe anyone in my squad ... behaved in any way that was dishonorable or contrary to the highest ideals that we all live by as Marines," he said, reading calmly and deliberately. "But even with the best intentions, sometimes combat actions can cause tragic results."

In a final plea for leniency, his civilian defense lawyer, Neal Puckett, said his client "is not evil."

"He is decent and moral, and his integrity is unfaltering," Puckett said. "He knows that his Marine Corps career has come to an end."

Any discharge process faced by Wuterich, a father of three girls, will be separate from his sentencing.

Called to the stand as a character witness on Tuesday, Jeffrey Dinsmore, an intelligence officer with Wuterich's battalion at the time of the killings, said "insurgent groups ... had complete control over the city (of Haditha) at the time" and the unit had received word that an ambush was likely. He also said insurgents were known to commandeer homes as places to launch attacks and to deliberately use civilians as human shields.

Six of the eight Marines originally accused in the case had their charges dismissed by military judges, and a seventh was cleared of criminal wrongdoing.

Wuterich enlisted in the Marines after his 1998 graduation from high school, where he was an athletic honor-roll student and played with the marching band. He was serving his second tour of duty in Iraq when the Haditha incident occurred.

Senate Legislation Targets Aggressive Recruiting Of Veterans By For-Profit Colleges

Over the past two years, for-profit colleges have been aggressively recruiting returning veterans in an effort to tap into billions of dollars in federal benefits available for soldiers to pay for college.

Not only have the schools have been eager to capture a new source of revenues, but former soldiers represent an added benefit for the industry: a way to secure more federal student loan and grant money.

By law, for-profit colleges must come up with at least 10 percent of their revenue from sources other than federal student aid programs in order to keep that money flowing.

The 90 percent threshold, known as the 90/10 rule, was put in place to ensure that at least 10 percent of the revenues at for-profit schools would come from the private sector, according to congressional testimony and reports from the early 1990s.

Yet many schools are complying with the requirement for private funds by dipping into a separate government revenue stream: educational benefits given to former military personnel.

The military subsidies, part of the new GI bill passed by Congress in 2008, aren't technically considered federal student aid funds, which gives corporations an incentive to actively pursue veteran enrollments.

Sen. Richard Durbin (D-Ill.) on Monday said he will propose legislation that would prevent for-profit colleges from counting the military assistance money as private funding. He, along with Sen. Tom Harkin (D-Iowa), plans to introduce the measure this week.

Durbin's legislation would, for the purpose of for-profit colleges, consider any benefits from the GI bill and the Department of Defense tuition-assistance program to be federal student aid revenues. The bill would also lower from 90 percent to 85 percent the amount of money that schools can receive from the federal government.

Lawmakers and advocacy groups say current practices have resulted in many returning veterans being steered into high-cost programs of dubious value.

Since the GI bill went into effect in 2009, it has "inadvertently created a federal bonus for the for-profit schools," Durbin told HuffPost.

"For-profit college companies have created aggressive marketing plans and a sales force specifically designed to target and enroll as many veterans, service members and family members as possible," Durbin said at a Monday forum on for-profit colleges and veteran enrollment in Chicago.

QUESTIONS ABOUT OUTCOMES

Trade groups representing for-profit colleges say that their schools are providing flexible course offerings and crucial career training for veterans returning from duty.

"Career colleges are proud to offer members of the military and veterans access to higher education and job training for in-demand careers," Penny Lee, managing director of the Coalition for Educational Success, an industry lobbying group, said in a statement.

Yet veterans advocates argue that the GI bill has created perverse incentives for the industry to prey on soldiers. Holly Petraeus, who handles military affairs issues at the Consumer Financial Protection Bureau, appeared with Durbin at Monday's forum and has raised concerns at past Senate hearings.

"Unfortunately, I think military folks at this point are seen like a dollar sign wearing a uniform for many recruiters in a for-profit model," she said at a hearing in July. "They're seen as cash that enables them to sell more of their product, and that's unfortunate," added Petraeus, who is married to CIA director and former Army General David Petraeus.

For-profit colleges are, on average, nearly twice as expensive as public four-year universities and cost nearly five times as much as public community colleges. But the expense of obtaining a college degree at a for-profit institution isn't necessarily translating into success in the workplace. A recent report by Harvard researchers found that students exiting for-profit colleges are more likely to be unemployed in the years after graduation than are those finishing traditional universities.

For-profit schools have higher graduation rates than public community colleges for short-term programs of two years and less but have significantly lower graduation rates for bachelor's degree programs.

While questions have been raised about whether these schools truly serve former military personnel, the institutions themselves have much to benefit from obtaining military subsidies.

PUBLIC FUNDS FUEL FOR-PROFIT SCHOOLS

The stakes involved are enormous for the for-profit college industry. For-profit institutions have struggled to find students willing to put up their own money for their programs but have ended up attracting mostly lower-income students who require federal aid. In order to create a private stream of revenue to comply with the 90/10 law, some schools have even gone so far as to increase tuition for some of their programs so that students must find outside private loans beyond what they receive from the government.

Complying with the law has become a central concern of higher-education companies and their shareholders. On quarterly earnings calls, executives at for-profit college companies are constantly quizzed about compliance with the law, and many have referenced the veteran-recruiting strategy in public filings with the Securities and Exchange Commission.

Internal documents from Kaplan University provided to Senator Harkin's staff showed a list of objectives related to recruiting of military, including "Grow our military enrollments to 9K per year by 2011" and "Improve 90/10 by 5 %." Among the strategies to achieve these goals were "Drive awareness via print advertising in key military publications and targeting key military installations."

As things stand today, many of the largest for-profit colleges receive more than 85 percent of their revenues from federal student aid programs, not counting military benefits. The Apollo Group, which owns the University of Phoenix, noted in a recent filing that 86 percent of its cash revenues came from federal student aid subsidies.

The Washington Post Co., which owns Kaplan University, another major industry player, said in a quarterly filing that a number of its schools could be in violation of the 90/10 rule this year, based on recent enrollment trends. Because of this, several Kaplan-run schools could be at risk of losing access to their federal funds, according to the filing.

In general, for-profit college corporations are enormous beneficiaries of government aid, relying almost entirely on the federal government for revenues and profits. In 2010, the industry took in more than $30 billion in federal student loan and Pell Grant dollars. And the eight largest for-profit college corporations received more than a half-billion dollars in veterans' assistance money from the Post-9/11 GI Bill during the 2010-11 school year.

Overall, for-profit colleges received nearly 40 percent of the $4.4 billion money given out under the GI bill program since 2009, despite educating only a quarter of the veterans using those benefits. By contrast, public colleges instructed 59 percent of the veterans and took in 40 percent of the GI bill money.

PROSPECTS FOR REFORM

Durbin will find that obtaining support for his bill will be a tough task,
as most Republicans in Congress have traditionally been strong backers of for-profit colleges. The current House speaker, John Boehner, was a strong supporter of eliminating the 90/10 rule when he chaired the House Education and Workforce Committee from 2001 to 2006.

The for-profit college industry has also hired many Democratic lobbyists in recent years, including former House Speaker Dick Gephardt, and lawmakers on the left have increasingly come to the aid of the industry. Lee, who heads the industry trade group, was a former top adviser to Senate Majority Leader Harry Reid and a senior staff member on the Democratic National Committee.

"The industry is going to fight tooth and nail," Durbin said. "There's so much money at stake here -- millions if not billions of dollars."

(AP) ? Bill O'Brien calls it an honor to follow the late Joe Paterno as Penn State's next head coach.

In an interview Monday in the same corner office that once belonged to the man known in State College as JoePa, O'Brien said he will forge his own coaching identity and that no one will ever replace Paterno, who won 409 games and two national championships.

Paterno died Sunday at age 85, a little over two months after his son, Scott, said his father had been diagnosed with lung cancer.

O'Brien never got to speak with Paterno in person following his hiring on Jan. 7.

The two did talk by phone soon after O'Brien arrived. O'Brien said he wanted Paterno to know he would preserve the Penn State traditions of winning and emphasizing academics.

"It wasn't a long conversation, but at the end it was pretty neat. I just wanted to make sure he knew that I was going to work very hard to keep it going here," O'Brien said.

O'Brien's still working at his old job, too ? as offensive coordinator for the Super Bowl-bound New England Patriots. He's traveling between Foxborough, Mass., and Happy Valley juggling duties.

O'Brien most recently arrived back in State College on Monday, and he plans to join his players for a viewing for Paterno on Tuesday before returning to New England on Wednesday night.

"To me, it's an honor to follow a guy like Coach Paterno," O'Brien said.

PFT: Cundiff feels bad for Ray Lewis? |?? 'Suck it up'

New England Patriots head coach Belichick embraces quarterback Brady after they defeated the Baltimore Ravens in the NFL AFC Championship football game in FoxboroughReuters

Tom Brady had one of his most memorable post-game moments on the AFC title game podium last night.

?Well, I sucked pretty bad today, but our defense saved us,? Brady said. ?And I?m going to try to go out and do a better job in a couple weeks.?

It was an interesting moment. Brady was obviously thrilled to go to the Super Bowl, but his press conference later showed that ?the night was almost bittersweet. Brady was still bothered by his performance. He missed too many open passes and made two big mistakes on interceptions.

Going home to Giselle apparently didn?t make things any better. Brady said his interception to Matthew Slater bothered him the most.

?That was probably the play that kept me up all night last night,? he said on WEEI this morning via ESPNBoston.com.

After the game, Brady went up to Patriots owner Robert Kraft and promised that he?d play better in the Super Bowl. Kraft didn?t sound too worried about his quarterback.

We wonder if Brady, aware of his own football mortality, was almost too amped up for Sunday?s game. Brady turns 35 this year and he knows these chances don?t come around every year.

?Not that I?ve ever taken for granted being there, because I certainly haven?t, but you really realize how hard it is to get there,? Brady said.

Brady says he still can?t watch highlights from the team?s loss in Super Bowl 42 because it was so painful. Now he will get a chance to make amends for the worst loss of his career in a legacy-altering rematch against the Giants.

Just a guess, but we doubt he sucks pretty bad again.

Tracy Morgan of '30 Rock' out of Utah hospital (omg!)

FILE - In this June 21, 2011 file photo, comedian and actor Tracy Morgan arrives at a news conference with Kevin Rogers, right, in Nashville, Tenn. PARK CITY, Utah (AP) ? Comedian and "30 Rock" cast member Tracy Morgan has been released from a hospital after collapsing during the Sundance Film Festival, and he says he'll be back at work Tuesday.

Morgan's publicist, Lewis Kay, confirmed Monday that the actor left the Park City Medical Center after he suffered from exhaustion and altitude Sunday night in Park City, where the elevation is 7,000 feet (2,140 meters).

Morgan posted a comment Monday on Twitter that the high altitude "shook up this kid from Brooklyn."

"Superman ran into a little kryptonite," he quipped.

He also said on Twitter that he would be back to work Tuesday on "30 Rock."

Ron Nyswaner, co-director of the Sundance film "Predisposed," in which the actor stars, said Morgan's collapse resulted from "altitude sickness combined with his diabetes. And he hadn't eaten. He hadn't had enough water."

Kay said hospital officials report no drugs or alcohol were found in Morgan's system.

Morgan had been attending an event for the Creative Coalition at which he had just received an award.

In "Predisposed," which stars Jesse Eisenberg and Melissa Leo, Morgan plays a drug dealer caught up in the push-and-pull between a piano prodigy and his troubled mother.

iBooks Author Gives You the Power to Design Your Own Book, Here's What You Should Know [Mac Downloads]

iBooks Author Gives You the Power to Design Your Own Book, Here's What You Should KnowApple announced its new education-focused apps last week and with a new version of iBooks they've also released a free tool for making ebooks, iBooks Author. Is this just a niche tool for creating textbooks or is there something useful you can do with it?

The niche factor is going to depend on what type of creative person you are. iBooks Author is geared toward making interactive textbooks for iPads, but it's also a simple tool to create any type of digital book you can imagine. Think of it like Adobe InDesign for iBooks and you're on the right track. So, what can you do with iBooks Author? Let's take a look at some of the ways you might get use out of it.

What You Can Do with iBooks Author

iBooks Author Gives You the Power to Design Your Own Book, Here's What You Should KnowApple bills iBooks Author as a way to easily create textbooks, but you can hack your way through it to create any type of book you want. If you're a photographer, it's simple to make and distribute a collection of your photographs. You can also use it as a digital scrapbook and collect together all your family footage into a package that can be easily shared with family. The interactive elements also make it easy way to create and release your own interactive children's books, comics, cookbooks, novels, or anything else you can imagine.

Stuff Interactive Elements Anywhere Your Like

If you use iWeb or Keynote you already have a grasp on the core concepts behind iBooks Author. The big difference between simply exporting a piece of text as an EPUB file and creating a book is the interactive elements. Let's take a look at the three main features you're likely to use.

  • Photos, Audio, and Video: For the most casual users, these three multimedia elements are the bread and butter of a personal iBook. Each has drag-and-drop functionality and all you have to do is drag the multimedia of your choosing onto the page you want and you're done.
  • HTML Snippets: The purpose of the HTML inclusion is to pull live content from the web. You might find use in this for your own book in a few ways. For instance, you can pull content from Twitter, display a Flickr slideshow, or include your blog's RSS feed.
  • Keynote Presentations: If you created a slideshow of your last vacation to show to friends you can automatically import it into iBook Author and give everyone something to take home. When you import a presentation, it retains all the animations, formatting and everything else.

You Can Create Your Own Templates but You Have to Edit Apple's First

Since Apple only includes a few templates to choose from, you want to make your own design to set the book apart. To create you own templates, you need to open a preexisting template and edit it. It's not difficult to do:

  • Step 1:Pick a template that's close to what you want. You'll notice the backgrounds and other elements are locked in place and seem like they can't be deleted. To edit the lines and background, select the element and click Arrange > Unlock. Now you can edit or delete the previously locked elements.
  • Step 2: Add background images or shapes you like. Get the page to look exactly how you like it. For backgrounds, right-click "Send to Back" so it doesn't move text out of the way.
  • Step 3: Once your chapter pages are set how you like. Right-click "duplicate chapter" and iBooks Author creates chapters identical to the one you made.

Editing this way isn't perfect, but following the above steps makes it so you can create and customize iBooks Author to your liking. Your own design also helps your book stand out so it doesn't look like it was created from a template.

What You Can't Do with iBooks Author

iBooks Author Gives You the Power to Design Your Own Book, Here's What You Should KnowAt its core, iBooks Author is built to make textbooks. You can hack your way through it easy enough, but it could be made a bit easier. It can't do everything. In fact, as a standard ebook creator it stinks because you can't export it in the industry standard EPUB format. It's good at creating books specifically for iBooks and that's it.

iBooks Author is Picky About its Formatting

iBooks Author doesn't support a few really common file types, including MP3. You can import audio files, but it only accepts AAC formats. You can import video, but only if its a Quicktime format. While iBooks Author accepts most word processor files, it doesn't always retain formatting. This means you'll lose your bolds, italics, and anything else you add. Basically, you have to tweak your content before you drop it into iBooks Author by formatting everything into the accepted file types, but don't bother with text because it often won't retain the formatting.

The iBooks Author User Agreement Can Be a Sticking Point

According to Apple's end user licensing agreement, you cannot sell your book through other outlets, so if you make a book with iBooks Author, you have to sell it exclusively through the iBooks app. This does not mean Apple owns the text, video, or photos, but rather the iBook package they're in. You can skirt around this issue by "self-publishing" your book and distributing the iBook file for free on your personal website (or share it directly with friends). However, in order to retain the multimedia facets of your book, you have to export it as an iBooks file and it can only be read in iBooks on an iPad. You can also export it as a PDF, but you lose all your multimedia content and still end up with an Apple watermark.

It's Free, but You Still Have to Pay to Sell Your Book

Finally, unlike publishing to Amazon's Kindle Marketplace, you have to purchase an ISBN (a book's barcode) if you want to sell your book in iBooks for a profit. Apple doesn't offer these through its store or its app, so you have to go through a third party like Bowker and pay around $100-$150 to purchase an ISBN number. You can still put your book up for free or share it privately with friends without the ISBN.

We're excited to see what people come up with and how they use it. It's not exactly made for designing your own books, but it's simple enough to hack together a means to do so. Do you plan on using iBooks Author to design your own book? Share it in the comments.

Two top Penn State board members step aside (Reuters)

PHILADELPHIA (Reuters) ? The two top officers of Penn State's Board of Trustees, enmeshed in the school's child sex abuse scandal, announced on Friday they would not seek re-election to their leadership posts.

Chairman Steve Garban and Vice Chairman John Surma, instrumental in the firing of the school's legendary football coach Joe Paterno, will be replaced by two incumbent board members.

At a board meeting in State College, trustees elected Karen Peetz as chairman and Keith Masser as vice chairman, selecting them to lead efforts to move the university past the damaging scandal.

Paterno, 85, was sacked in November for failing to tell police what he knew about child sex abuse allegations against former assistant coach Jerry Sandusky. Also fired was university president Graham Spanier.

Sandusky faces 52 charges stemming from accusations by 10 men who say he molested them as juveniles over a 15-year period. The 67-year-old Sandusky has maintained his innocence

"These have been difficult days at Penn State," said Garban, the board chairman since 2010, in stepping down. He also is a former Penn State vice president for finance and operations.

Surma, who is chief executive officer of U.S. Steel Corp., said: "I cannot continue to serve in a board leadership role at the level of intensity we have been experiencing."

Both said they would remain as members of the 32-member board.

Critics of the board, including those who belong to an alumni group called Penn Staters for Responsible Leadership, were unimpressed with the changes. The group, formed last fall as the scandal grew, is seeking more transparency as to how board decisions are made.

"This is nothing more than musical chairs," said Maribeth Roman Schmidt, spokeswoman for the group.

"It's the same folks, on the same board, sitting in different seats," she said, "We don't see that as a change in the least bit."

The alumni group is hoping to fill three board seats coming open in May with candidates who support more open decision-making. The three seats are among eight on the board that are elected by alumni.

Garban and Surma issued a joint statement last week describing their decision to fire Paterno, a move that set off a firestorm of alumni protest.

A member of the College Hall of Fame, Paterno was head coach of the Nittany Lions for 46 years. With 409 victories at Penn State, he won more games in big-time college football than any other coach in the sport's history. A few days after Paterno was fired, his family said he was suffering from lung cancer.

New board chair Peetz is vice chairman of the Bank of New York Mellon. Masser runs a family farm in Pennsylvania.

Los Angeles judge suggests Terrell Owens' NFL career is over

By

January 04, 2012

LOS ANGELES -- Los Angeles County Superior Court Judge Marc Marmaro was obviously one of the few who actually watched Terrell Owens' televised October workout.

And like the league general managers before him, Marmaro's critique was to the point Wednesday when he heard the former NFL wide receiver's request to reduce the amount of child support he has to pay in two of his four ongoing paternity cases, TMZ reported.

"His NFL career seems to be over. I mean no disrespect," the judge said to Owens' lawyer in court, later adding that maybe there was a chance the six-time Pro Bowler could make it back to the big time via the Arena Football League.

The cash-strapped 38-year-old has been selling off assets at a loss recently in a bid to cover his sizeable debts. He has requested that his child support payments be reduced because of his lack of income.

Marmaro said Wednesday he needed some time to consider the request before making a decision.

After being confronted by a TMZ cameraman outside the court, Owens reacted angrily on Twitter, posting "@TMZ Where do u draw the line? My grandmother passed yesterdy,2day I go 2 court & as I'm leaving u stick a camera n my face! It's hard enuff."

Owens held a televised workout in California in October, hoping to convince an NFL team to sign him after suffering an offseason knee injury.

But the exercise failed and it later emerged he missed a court date regarding his child support payments because of the well-publicized session, only adding to his off-field problems.

Owens has played for five teams in 15 seasons. He amassed 983 yards and nine touchdowns for the Cincinnati Bengals last season, moving into second on the all-time receiving yards list behind Jerry Rice at 15,934.

Comparison of Pending Right to Work Legislation (ContributorNetwork)

The first day of a new legislative session in Indiana was halted because most of the Democratic state representatives decided to stay home from work and prevent a quorum, according to the New York Times. The Republican majority had planned to introduce "right to work" legislation, making Indiana the 23rd state to permit voluntary union membership. A similar amendment may soon be on the ballot in Ohio, according to the Toledo Blade.

Indiana

Governor Mitch Daniels favors the "right to work" legislation and stated that the pending bill is designed to create new job opportunities, according to Reuters. Indiana Democrats and union members are preparing to fight any attempted changes to mandatory membership at public employee workplaces and private businesses where unions exist. According to Reuters, pro-union forces are promising statehouse protests like those which occurred in Ohio and Wisconsin last year.

If approved, the "right to work" law ends the ability of labor unions to force employees to join or pay any type of dues to the organization. Last year when similar legislation was introduced Democratic lawmakers fled to Illinois for five weeks to avoid taking a vote on the bill, according to Reuters. Governor Daniels initially planned security changes at the state house to avoid the pandemonium which occurred in Ohio and Wisconsin during union legislation debates last year, according to the Indy Star. Although Daniels repealed some of his initial plans to limit entrance to 3,000 visitors and restrict public access to some elevators and doors, an increased state trooper presence is still visible at the governmental building.

Ohio

The 1851 Center for Constitutional Law is attempting to get a "right to work" proposal on the ballot in Ohio, according to the Toledo Blade. The group began working on the amendment prior to the fall 2011 election which the Ohio Senate Bill 5 repeal issue. Months of statehouse protests in Ohio preceded the approval of the bill which would have required merit based pay for public employees, put an end to teacher tenure and collective bargaining reforms.

Ohio Attorney General Mike DeWine was unable to certify the initial wording of the proposed ballot issue because the wording failed to detail legal remedies available under the amendment's mandate, according to the Toledo Blade. Like the Wisconsin law, Senate Bill 5 would have limited collective bargaining rights of public employees to specific issues. The Republican sponsored legislation would have also ended the practice of outside arbitration during public employee union contract disputes.

Wisconsin

Ohio, Wisconsin and Indiana began collective bargaining reform battles at approximately the same time last year, only Wisconsin being successful in getting legislation passed, according to the Washington Post. Thousands of protesters gathered on the statehouse law chanting "shame" at conservatives who supported alterations to the state's union membership and bargaining policies. Recall elections prompted to remove those who supported union reform failed, according to the Post. Unlike Ohio's collective bargaining reform legislation, the Wisconsin bill made exceptions for firefighters and police officers.
